Irpin Mayor Oleksandr Markushyn returns to his duties

Over the past week, two different judges of the Pecherskyi District Court of Kyiv – Kristina Konstantinova and Tetiana Ostapchuk – have failed to rule on the extension of Oleksandr Markushyn’s suspension from office despite intense pressure from the SBI.
Judge Konstantinova actually withdrew from the proceedings, and Judge Ostapchuk postponed the case, recognizing the obvious inadmissibility of the repeated motion.
This means only one thing: the Pechersk court has actually recognized that the prosecutor is abusing his powers, and his suspension from office cannot be extended.

  • On June 17, a SBI investigator files a motion with the Pechersk Court to extend the term of Oleksandr Markushyn’s suspension from office. The case is considered by Judge Kristina Konstantinova, but on June 19, she leaves for a meeting room for another case and does not complete the hearing.
  • On June 20, the investigator and the prosecutor commit a brazen procedural manipulation – they file a second motion with identical content.

This time, the case is being considered by Judge Tetiana Ostapchuk, who, after a reasoned defense position, admits that it is impossible to consider something that is already in the proceedings of another judge and postpones the hearing to June 23 at 09:30.

The key:

June 20 is the last day of the previous suspension period, so from that moment on, Oleksandr Markushyn will be automatically reinstated in his position. The law does not provide for any additional decisions for this purpose.
However, no sooner had the court session ended than in 10 minutes the investigator – apparently on the direct instruction of the “customers” of the case – summoned Oleksandr Markushyn on Saturday to serve a third motion for his removal, this time under the guise of a “new” one. This fact once again emphasizes that the only purpose of the case is to raid the Irpin community by removing Oleksandr Markushyn from the position of mayor.
On Monday, they will try to return to the Pechersk court for the third time (!).
Miller’s lawyers are ready for the next round. There will be no new evidence for the suspension – because it simply does not exist.
Time will tell whether the Pechersk District Court is ready to fulfill the political order on the eleventh day since the notification of suspicion and the third time in a week.
This is no longer criminal justice. This is an instrument of political reprisal. And here is a question for every investigator, prosecutor, and investigating judge: what does it feel like to be dependent and non-subjective tools in someone’s interests?
